3-11 POLICE/FIRE ALARMS AND DIRECT WIRED ALARM MONITORS ORDINANCE

General Policies and Application Requirements

11.1
The Town of Kennebunk will only accept applications for monitors if the structures to be monitored are within the boundaries of the Town of Kennebunk. Only intrusion or fire alarm monitors will be accepted.

11.2
Applications to install an alarm monitor shall be made by the owner, lessee, proprietor or other such person having a vested interest in the subject property. Applications shall be in writing. The applicant shall be required to comply with the rules and regulations set forth by the Town of Kennebunk governing the installation and maintenance of said alarm monitors.

11.3
Applications shall be acted upon by the Police or Fire Chief within one month of receipt. Installation may not occur until said approval has been received by the applicant.

11.4
The applicant shall be responsible for providing the Town of Kennebunk with the names, addresses and telephone numbers of three local persons who will be responsible for the property in the absence of the applicant, at least one of whom will be available to respond at the request of the Town of Kennebunk to provide access to the premises to assist in the resetting of the system.

11.5 Municipal Fees

A fee shall be charged by the Town of Kennebunk on an annual basis. Said fee shall be set by the Board of Selectmen. The Board may set separate levels of fees based on the type of applicant.

11.6 False Alarm Penalty Fees

Three false alarms of each type (police or fire) per unit, whether monitored directly or indirectly, per year will be allowed without penalty.

11.7
If Police or Fire Department is notified by an authorized person that the alarm was inadvertently tripped, and if no response is required, said instance shall not be counted as a false alarm.

11.8
If the alarm was activated by electrical power failure off the premises, said instance shall not be considered the fault of the owner and shall not be counted as a false alarm.

11.9
After three false fire alarms during a one year period, the owner shall be assessed a penalty as set by the Board of Selectmen’s fee schedule for each additional instance, payable to the Town of Kennebunk. After three false police alarms during a one year period, the owner shall be assessed a penalty as set by the Board of Selectmen’s fee schedule for each additional instance, payable to the Town of Kennebunk.

11.10
Fees shall be as shown on a fee schedule set by vote of the Board of Selectmen each year, after notice and hearing. (06-12-2002)
